Why This Notice
This page describes how to manage the site with reference to the processing of personal data of users who consult it. Following consultation of this site, data relating to identified or identifiable persons may be processed.

The information is also based on Recommendation no. 2/2001 that the European authorities for the protection of personal data, gathered in the Group established by art. 29 of the directive n. 95/46 / EC, adopted on 17 May 2001 to identify some minimum requirements for the collection of personal data online, and, in particular, the methods, timing and nature of the information that the data controllers must provide to users when they connect to web pages, regardless of the purpose of the link.

The computer systems and software procedures used to operate these websites acquire, during their normal operation, some personal data whose transmission is implicit in the use of Internet communication protocols.
This is information that is not collected to be associated with identified interested parties, but which by their very nature could, through processing and association with data held by third parties, allow users to be identified.
This category of data includes the IP addresses or domain names of the computers used by users who connect to the site, the URI (Uniform Resource Identifier) addresses of the requested resources, the time of the request, the method used to submit the request to the server, the size of the file obtained in response, the numerical code indicating the status of the response given by the server (successful, error, etc.) and other parameters relating to the operating system and the user's IT environment.
These data are used only to obtain anonymous statistical information on the use of the site and to check its correct functioning and are deleted immediately after processing. The data could be used to ascertain responsibility in case of hypothetical computer crimes against the site: except for this possibility, the data on web contacts do not persist for more than seven days.
Data provided voluntarily by the user
Acetificio Carandini Emilio S.p.A. will process the personal data that the user will provide when registering, requesting a specific service or in any case as part of the relationship with the portal www.carandini.it
Such data may include:
• identification and contact data (name, surname, residence / domicile address, city, e-mail address, telephone number, etc.);
• payment and billing data (data relating to credit cards and other payment systems used by the user);
The provision of personal data is a necessary requirement for the provision and consequent use of the requested Services. Failure to provide certain data (personal data, e-mail address, and payment data etc.) therefore, could make it impossible for the Data Controller to provide the requested Services.
With regard to payment data, these will not be processed by the carandini.it portal, since at the time of payment of the order, the user will be redirected to the paypal page (paypal payment circuit). Acetificio Carandini Emilio S.p.A. subsequently receives confirmation of payment.
Acetificio Carandini Emilio S.p.A., will indicate from time to time, also through its forms on the carandini.it portal, the data whose conferment is strictly necessary for the use of the Services and the additional data whose conferment is instead necessary only in order to enrich your user experience in the context of the Services themselves.
Owner, Data Processor and DPO
The Data Controller is Acetificio Carandini Emilio S.p.A., in the person of the legal representative. The list of external data processing managers is constantly updated and can be consulted at the company's registered office. The DPO has not been appointed.
Purpose of the processing for which the data are intended
The personal data you provide will be used for the following purposes:
a) For the execution of the contract or in any case to provide Services requested by the user on the carandini.it portal
- manage registration, authentication and access to the portal
- provide information services on products;
- manage product purchase requests;
- manage contact operations through the "contact us" area of the website;
- manage correct navigation on the www.carandini.it portal.
b) For the fulfillment of legal obligations (such as, by way of example, tax obligations related to the execution of the contract and the provision of services);
c) sending communications regarding the services offered, newsletters and personalized news, containing material and promotional initiatives of their activities and services with automated methods (e-mail).
Nature of the Contribution
The provision of data is mandatory with regard to the purpose in point a) and b): any refusal will make it impossible for Acetificio Carandini Emilio S.p.A. to proceed with the complete provision of the services offered.
Consent for the purpose in point c) is optional and will have the sole consequence of failing to send advertising messages or newsletters, without prejudice to the provision of the service offered.
Processing methods
All personal data are mainly processed through electronic tools and methods, however processing by paper means is not excluded a priori.
The data will be stored in a form that allows the identification of data subjects only for the time strictly necessary to achieve the purposes for which the data were originally collected and, in any case, within the limits of the law.
In order to ensure that personal data are always accurate, updated, complete and relevant, we invite users and other interested parties to keep their data updated through the specific functions of the sites and applications connected to the www.carandini.it portal, or to report any changes made to the following e-mail address: info@carandini.it.
Personal data will be processed only for the time necessary in relation to the purposes described above.
Security measures will be used to ensure the confidentiality of the data subject to whom these data refer and to avoid undue access to third parties or unauthorized personnel.
Place of data processing
The treatments connected to the web services of this site take place at the legal and operational headquarters of Acetificio Carandini Emilio S.p.A. and are only handled by specifically appointed personnel; the data are also processed in any other place where the parties involved in the processing are located. In particular, all the data relating to the website, as well as the relative security copies, are stored on servers hosted in data centers within the European Union and in compliance with current Community regulations.

Data processing times
The data is processed for the time necessary to perform the service requested by the user, or required by the purposes described in this document, and the user can always request the interruption of the processing or the cancellation of the data.
Disclosure of data to third parties
No data will be disseminated. Where communication to third party suppliers, consultants or partners should be necessary for needs related to the provision of the Services, the Data Controller will be responsible for appointing the latter as data processors pursuant to art. 28 of the Regulation, by virtue of the demonstrated ability, experience and reliability.
The identification data could be communicated to transport companies with which Acetificio Carandini Emilio S.p.A. has entered into contracts for the delivery of products purchased on the websites of the Data Controller.
Interested parties can request at any time the complete list of data processors appointed from time to time by Acetificio Carandini Emilio S.p.A., by sending a request to the Data Controller at the e-mail address info@carandini.it.
It is understood that users' personal data may be freely disclosed to third parties, such as police forces or other public administrations, whenever this is permitted by law or required by an order or provision of a competent authority. These subjects will process the data as independent data controllers.
Ownership of the treatment of cookies
Since the installation of third-party Cookies and other tracking systems through the services used within this site cannot be technically controlled by the Owner, any specific reference to Cookies and tracking systems installed by third parties is to be considered indicative.

d) withdraw your consent at any time (however, the withdrawal of consent does not affect the lawfulness of the processing based on consent before the withdrawal);
e) obtain the limitation of the processing;
f) obtain data portability, i.e. receive them from a data controller, in a structured format, commonly used and readable by an automatic device, and transmit them to another data controller without hindrance;
g) oppose the processing at any time and also in the case of processing for direct marketing purposes;
h) oppose an automated decision-making process relating to natural persons, including profiling;
i) obtain confirmation of compliance with the provisions of art. 19 EU Regulation 2016/679 by the Data Controller, or the communication - to each of the recipients to whom the personal data have been transmitted - of any corrections or cancellations or limitations of the processing carried out pursuant to art. 16 EU regulation 2016/679, except in the case in which this fulfillment proves impossible or involves a disproportionate effort;
j) lodge a complaint with the competent supervisory authority.

Terms and Conditions of Sale
www.carandini.it belonging to Acetificio Carandini Emilio SPA, a company with registered office in Via per Formigine 54/A, Castelnuovo Rangone (MO) entered in the companies register Economic Administrative Index no. MO no. 247721, VAT number 01858700360, mail info@carandini.it indicated as "Seller” below.
1) Purchasing procedures and acceptance of sales conditions
All distance contracts of our products are concluded directly through the customer/consumer’s (hereinafter simply "Customer") access to the website www.carandini.it (hereinafter simply "Site"). They will be able to select the products displayed on the sales catalogue, as described in the respective product information sheets, and conclude the contractual purchase agreement for the desired product (s) by including them in the "shopping cart" function which provides for subsequent forwarding of the order to the seller through the user’s consent with a click on the buy and pay button.
The agreement between the parties is finalized with the sending of the order and the receipt by the Seller of payment for the ordered goods. The payment of the goods constitutes an essential part of the purchase contract, in fact the non-receipt of the latter by the Seller will cancel the purchase contract with the consequent failure of the obligation to forward the goods.
The payment of the goods, for the purpose of concluding the purchase contract, must be made exclusively through one of the methods indicated in the following paragraph 3.
The order sent by the Customer to the Seller through the Site must be completed in its entirety and must contain the elements necessary for the identification of the Customer and the products ordered and the indication of the place of delivery, on penalty of invalidity. The Seller will send an order confirmation to the Customer via e-mail.
As approved by art. 48 of Legislative Decree 206/05, the general conditions must be read and approved by the Customer before the conclusion of the contract. By sending the order, the Customer simultaneously declares to have read all the information provided to him/her during the purchase procedure and to fully accept these general sales conditions.
If the Customer is a consumer (i.e. a natural person who buys the goods for purposes not related to his professional activity), once the online purchase procedure is completed, he/she will print or save an electronic copy and in any case keep these general conditions of sale, in compliance with the provisions of Italian legislation on distance contracts.
The relative document or, if required, the invoice certifying the sale of the product (s) will be delivered together with the goods and/or by e-mail to the address indicated by the Customer at the time the goods are prepared for departure.
2) Products, prices and additional costs
The visual representation of the products on the Site, where available, is intended to illustrate the product and corresponds to the photographic image representative of the product’s characteristics, however it may be slightly different in colour.
If a product is shown on the Site in areas other than the specific sections intended for the purchase of products or in any case without the "add to cart" icon, it is not available for sale through the Site. The unavailability of the product is temporary up to new supply.
All product prices are clearly indicated on the Site and refer to the unit price per package including VAT. The Site can only receive orders with delivery in Italy and in the following European countries: Austria, Belgium, Croatia, Denmark, France, Germany, Finland, Greece, Ireland, Luxembourg, Monaco, Netherlands, Portugal, Spain, Sweden, United Kingdom , Bulgaria, Cyprus, Czech Republic, Estonia, Hungary, Latvia, Lithuania, Malta, Poland, Romania, Slovakia, Slovenia and in the following Extra EU countries: Republic of San Marino, Norway, Switzerland, Montenegro, Serbia, Ukraine, Liechtenstein, Albania, Andorra and Bosnia & Herzegovina.
The seller reserves the right to change product prices and shipping costs at any time and without notice, it being understood that, limited to orders being accepted or already accepted by the Seller (for which payment for the ordered goods has already been received ), the sales conditions in force at the time the order is sent will apply, with the exclusion of orders not accepted (orders for which the customer has not received confirmation of receipt of the order by e-mail) and rejected.
Transport costs are listed separately, clearly for the Customer within the "shopping cart" function before purchase confirmation. Before sending the order, the Customer can view it and if he/she deems it appropriate, he/she can abandon the purchase without any obligation to spend.
The cost of each shipment may vary according to the number of products purchased, the weight and size of the packaging.
Shipping costs are taken to be up to the ground floor of the place of destination indicated by the customer when placing the order and are listed separately in the "shopping cart" under the heading "Checkout”.
Any additional ancillary expenses - by way of example but not limited to, linked to customs fees, monetary inflation, etc. - will be communicated to the Customer by e-mail from the courier before shipment of the goods; in case of an e-mail of non-acceptance by the Customer of the additional costs indicated, the order will be considered cancelled and the contract will be considered void.
If additional charges are incurred, they may refer to bank commissions provided for by the agreements of individual customers with their credit card issuers or banks. These charges do not depend directly on the Seller, which cannot be held responsible in any way.
3) Payment terms
Payment must only be made in Euro.
I. Credit cards: by selecting this payment method, the Customer's browser is automatically redirected to the site responsible for payment, showing the order summary data and the parameters necessary for completing the transaction. The browser connects to the page containing a form in which the customer must enter the data relating to his/her credit card or chosen method with which he/she intends to make the payment. Once the payment transaction is completed, the user can be redirected to the Seller's site or choose to continue browsing.
II. PayPal: this is a system that allows transactions to be carried out online (purchases, payments, transfers) but without the data of one's card or bank account being shared with the recipient of the payment. To use PayPal, you must register on the site and open an account, you can link a credit card or a prepaid card to it or top up by bank transfer from your bank account. When you have money in your account you can pay for the products by following a simple wizard provided by the PayPal function. 4) Shipping and pick-ups
Deliveries will be made as soon as possible upon receipt of payment by courier indicated by the Seller. The goods will be shipped from the factory in Castelnuovo Rangone (MO).
The risks deriving from the transport of the goods shall be borne by the Seller until delivery is made. The risk will be transferred to the Customer upon delivery of the products to the Customer, or to those designated by him for the receipt of the goods, by the shipper.
The courier makes a first and second delivery attempt for each shipment, in the absence of the customer he will leave a notice with the necessary contact information and retry delivery on the first working day available. The Customer must arrange for collection of the products by making themselves available. The Customer acknowledges that the collection of the products represents an obligation deriving from the sales contract concluded with the Seller. Therefore, in the event that even the second delivery attempt by the courier is unsuccessful, the contract shall be deemed terminated by law pursuant to art. 1456 of the Civil Code, with a simple communication by the Seller sent by e-mail to the Customer, and, therefore, to all intents and purposes the order will be cancelled. Within 15 days of the aforementioned communication, the Seller will then reimburse the total amount paid by the Customer for the products, minus the costs of the unsuccessful shipment, the costs of returning the products to the Seller and any other expense that the Seller has incurred through non-delivery due to the absence or inaction of the Customer in fulfilling the obligation to receive the delivery.
The reimbursement due in the previous paragraph will be credited to the same payment method used by the Customer.
Once the refund has been made as described, if the Customer wishes to request delivery of the products, he/she will necessarily have to proceed with a new order.
5) Product defects and returns
Upon receipt of the Products, the Customer must check their compliance with the order, paying particular attention that:
- the number of packages indicated on the carrier's delivery note corresponds to the number of packages actually delivered;
- the package is intact and not damaged or tampered with. Any anomalies (such as, for example, tampering with or damage to the packaging) must be specifically indicated in writing directly on the courier's delivery note, and the Customer must refuse delivery. At the same time, the Customer will be required to report the fact to the Seller’s Customer Service, by reporting it immediately to customerservice@carandini.it.

All communications that, pursuant to the General Conditions, are made by e-mail will be sent to the address communicated by the Customer during the Registration phase.
7) Applicable law and jurisdiction
The sale contract concluded under the General Conditions is governed by Italian law.
For any dispute that may arise regarding the interpretation of the General Conditions and the execution of the contract concluded pursuant to the aforementioned, the Court of the User's place of residence or domicile will have jurisdiction, in the case of a consumer resident or domiciled in Italy. If the User is not resident or has no domicile in Italy, for any controversy that should arise between the Seller and the Customer regarding the interpretation of the General Conditions and the execution of the contract concluded in accordance with the aforementioned, in the case of action promoted by the Seller, the latter may choose between the Court of Modena and the Court of the place of residence or domicile of the Customer, alternatively between them; in the event of action brought by the Customer, the Court of Modena will have sole jurisdiction.
8) Privacy
Pursuant to Article 13 of EU Regulation 679/2016/EU Iperal S.p.A. processes data provided by the Customer in compliance with the legislation on data privacy as better specified in the privacy statement on the site in the “Privacy Policy” section.
9) Organisation, Management and Control Model pursuant to 231/2001
The Customer declares to be aware that Acetificio Carandini has adopted and implements an Organisation, Management and Control Model pursuant to Legislative Decree 231/01, with the relative Code of Ethics and Disciplinary System which he declares to have read from the company website and which he declares to have understood.
The Customer declares to adhere to the principles of the aforementioned Organisation, Management and Control Model as well as its annexes and undertakes to respect its contents, principles and procedures and, in general, to refrain from any behavior aimed at configuring the hypotheses of offense indicated in Legislative Decree 231/01 and its subsequent amendments and additions and reported in the aforementioned Organisation, Management and Control Model.
The Customer also undertakes to respect all the principles contained in the aforementioned documentation and the behavioral protocols envisaged by the Seller pursuant to Legislative Decree 231/2001, relieving the latter from any legal, economic and legal consequences that may derive from the violation of the same.
10) Billing
For all users who wish to receive an invoice following the purchase, it is mandatory fill in the Codice Fiscale/Tax Number/VAT Number field on the screen after checkout.
Otherwise it is possible to request an invoice by sending an email to shop@carandini.it or through the filling in the form http://carandini.it/functions/... within the current fiscal year time of order.
